Are you sure this photo is the Dutchman?, because I've read that he didn't die immediately, was hospitalized and rambled on for some time in a delirium with a stenographer writing it all down.

The story is that Murder Inc. gunmen shot Schultz while he was at the urinal in the Palace Chophouse in Newark, but he was able to make it into the restaurant, where he collapsed in a chair until the ambulance arrived.

According to that story, it's entirely plausible that the picture is of Dutch, which also explains why the victim in the photo is still wearing a winter coat at the dinner table.

The interesting thing about this for me is the fact a photographer was johnny-on-the-spot - Dutch wasn't dead yet, and here's a piccie before the meat wagon is even there. If it was a police photog, there's more than a bit of talent in that shot.
